Terms of Use — PlayroomNearby

These Terms of Use (the “Terms”) govern your use of the PlayroomNearby mobile application, the Playroom Nearby website and related services (together, the “Service”).

1. Service Provider

In these Terms, “PlayroomNearby,” “we,” “us” and “our” refer to the Service operated by the provider identified above.

2. Acceptance of these Terms

By creating a PlayroomNearby account, submitting user-generated content or otherwise using functionality for which acceptance of these Terms is required, you agree to these Terms.

Our Privacy Policy explains how PlayroomNearby processes personal data and should be read together with these Terms.

Acceptance of these Terms does not constitute consent to optional analytics or other processing where applicable law requires separate consent.

If you do not agree with these Terms, you must not create an account or use account-only functionality.

3. What PlayroomNearby Does

PlayroomNearby is a discovery and information service primarily designed to help parents, guardians and other adults find:

• playrooms;
• children's activities and classes;
• sports activities;
• workshops;
• playgrounds;
• family-friendly venues;
• events;
• educational and recreational activities;
• other places and services relevant to families with children.

The Service may display information including:

• descriptions;
• addresses and map locations;
• age suitability;
• categories and filters;
• opening hours;
• price information;
• photographs;
• contact information;
• ratings and reviews;
• information supplied by venues and organizers.

PlayroomNearby primarily acts as an aggregator and discovery platform.

Unless expressly stated otherwise in relation to a particular service, PlayroomNearby is not:

• the operator of a listed venue;
• the organizer of a listed activity;
• a childcare provider;
• the employer of venue staff;
• the provider of the underlying third-party activity;
• a booking or payment provider for third-party services.

4. Eligibility

You must be at least 18 years old to create a PlayroomNearby account.

The Service is intended to be used by adults when searching for places and activities for children.

PlayroomNearby does not require users to create accounts or profiles for their children.

5. Using PlayroomNearby Without an Account

Core discovery functionality may be available without registration.

Depending on the relevant version of the Service, this may include:

• browsing listings;
• searching;
• using filters;
• viewing places and activities;
• using maps;
• viewing contact information;
• opening external directions.

An account may be required for functionality including:

• Favourites;
• likes or dislikes;
• ratings;
• written reviews;
• other personalized account features.

6. User Accounts

To create a PlayroomNearby account, you must provide:

• an email address;
• a password.

PlayroomNearby does not use Google Sign-In or Sign in with Apple as standard account-registration methods.

You must use an email address that you are entitled to use.

You are responsible for:

• keeping your password confidential;
• maintaining reasonable security over your account;
• activity carried out through your account where caused by your actions or failure to protect your credentials.

You should notify PlayroomNearby if you reasonably believe your account has been accessed without authorization.

You must not:

• impersonate another person;
• create an account using an email address you are not entitled to use;
• sell or transfer your account;
• create accounts for fraudulent or abusive purposes;
• use automated methods to create large numbers of accounts;
• attempt to bypass authentication or security mechanisms.

7. Free Parent-Facing Service

At the effective date of these Terms, ordinary parent-facing use of the PlayroomNearby discovery Service is offered free of charge.

Creating a standard parent account does not create a payment obligation.

PlayroomNearby may offer separate commercial products or services to playrooms, activity organizers, advertisers or other partners.

Such commercial services may be subject to separate agreements or commercial terms.

If paid consumer functionality is introduced in the future, the applicable price and material terms will be disclosed before the user enters into the relevant paid transaction.

8. Listings and Third-Party Information

Information about places and activities may be obtained from:

• venues and organizers;
• publicly available websites;
• public social-media profiles;
• direct communications with businesses;
• PlayroomNearby research;
• other lawful sources.

We aim to make listings useful and reasonably accurate.

However, information relating to independent third parties can change without notice.

For example:

• opening hours may change;
• prices may change;
• an activity or event may be cancelled;
• a venue may temporarily close;
• a venue may be unavailable because of a private event;
• age requirements may change;
• contact information may change;
• photographs and descriptions may become outdated.

You should verify information that is important to your decision directly with the relevant venue or organizer before travelling, attending an activity, making a reservation or making a purchase.

9. No Automatic Endorsement or Safety Certification

The presence of a venue or activity in PlayroomNearby does not by itself mean that PlayroomNearby guarantees or formally certifies that venue or activity.

Unless expressly stated otherwise, we do not independently guarantee:

• the safety of a venue;
• quality of services;
• qualifications of staff;
• availability;
• suitability for a particular child;
• accessibility;
• accuracy of every statement provided by a third party;
• compliance by an independent organizer with every legal or regulatory requirement applicable to that organizer.

A featured listing, premium placement, partner designation or similar commercial feature does not constitute a safety certification.

10. Responsibility of Parents and Guardians

PlayroomNearby helps users discover options.

It does not replace the judgment of a parent or guardian.

Parents and guardians remain responsible for deciding whether a particular venue or activity is appropriate for their child.

Where relevant, users should confirm matters including:

• age requirements;
• supervision arrangements;
• health and safety conditions;
• food and allergy requirements;
• accessibility;
• equipment;
• instructor qualifications;
• opening hours;
• prices;
• booking and cancellation conditions.

11. Favourites

Registered users may save places and activities to Favourites.

Favourites are provided as a convenience and personalization feature.

PlayroomNearby may also use aggregated and non-identifying information about Favourites to understand the popularity of listings and improve the Service.

Adding a listing to Favourites does not give the relevant organizer access to your email address, account identity or individual Favourites history.

12. Likes, Dislikes and Ratings

Registered users may be able to express opinions through likes, dislikes or ratings.

PlayroomNearby may use these interactions to:

• provide relevant product functionality;
• calculate aggregated information about listings;
• understand how listings are used.

We may remove, disregard or restrict interactions that we reasonably believe are fraudulent, automated, manipulated or abusive.

13. Reviews and User-Generated Content

Registered users may be able to submit written reviews.

13.1 Pre-publication moderation

Reviews intended for public display are reviewed before publication.

A submitted review may be:

• approved;
• rejected;
• withheld from publication;
• removed after publication.

Submitting a review does not create a right to publication.

13.2 Review rules

Reviews must reflect a genuine experience or opinion.

You must not submit content that:

• you know to be false or fraudulent;
• contains threats or harassment;
• contains discriminatory, hateful or abusive content;
• is obscene or unlawful;
• constitutes spam or unauthorized advertising;
• contains irrelevant personal attacks;
• unnecessarily discloses another person's personal information;
• contains identifying personal information about children;
• infringes copyright, trademark or other rights;
• contains confidential information that you are not entitled to disclose;
• contains malicious links, code or software;
• attempts to manipulate ratings or reviews;
• otherwise violates applicable law or these Terms.

13.3 Reporting inappropriate content

PlayroomNearby provides a mechanism for users to report reviews or other user-generated content that they believe violates these Terms.

We may investigate reports and take appropriate action.

13.4 Abusive users

We may warn, restrict, suspend or block users who abuse the review system or repeatedly violate these Terms.

13.5 Public identity

Your account email address will not be displayed publicly together with your review.

An approved review may be displayed under a generic or otherwise non-identifying user label.

14. Licence for User-Generated Content

You retain ownership of original content that you submit to PlayroomNearby.

By submitting content intended for publication, you grant PlayroomNearby a non-exclusive, worldwide, royalty-free licence to:

• host;
• store;
• reproduce;
• technically format;
• moderate;
• display

that content as reasonably necessary to operate the Service.

You represent that:

• you have the right to submit the content;
• the content does not unlawfully infringe another person's rights;
• PlayroomNearby may use the content as described in these Terms.

Deletion of your account may result in removal or irreversible anonymization of account-associated user-generated content as described in the Privacy Policy.

15. Maps and Location Functionality

PlayroomNearby provides map and location-based functionality.

If you choose to use functionality that requires your current location, the application may request permission from your device's operating system to access your precise location.

Location permission is optional.

You may refuse or disable it through your device settings.

If location access is disabled, certain nearby-location functionality may not work as intended.

The embedded PlayroomNearby map uses map data based on OpenStreetMap and map-rendering technologies including MapLibre.

Maps, coordinates, distances and location information are provided for discovery and orientation purposes.

They should not be treated as a guarantee of precise navigation, access or real-world conditions.

16. External Directions and Services

PlayroomNearby may provide links or actions that open an external service.

For example, you may choose to open directions using Google Maps.

When you choose to use an external service, you leave the PlayroomNearby environment.

Your use of that external service is governed by the third party's own terms and privacy practices.

PlayroomNearby is not responsible for the accuracy, availability or operation of independent external services.

17. Direct Contact With Venues and Organizers

Listings may contain:

• telephone numbers;
• email addresses;
• websites;
• social-media profiles;
• addresses;
• external directions;
• other third-party contact information.

If you contact an organizer directly, that communication takes place between you and the organizer.

PlayroomNearby is not responsible for an independent organizer's:

• communications;
• privacy practices;
• commercial terms;
• actions;
• products or services.

18. Bookings and Payments

PlayroomNearby does not currently process consumer payments through the application and does not currently act as the payment provider for listed venues or activities.

Unless expressly stated otherwise in relation to a future PlayroomNearby feature, any booking, reservation or purchase made directly with a venue or organizer is a transaction between you and that third party.

The organizer's own prices, payment conditions, cancellation rules and other terms may apply.

19. Organizer and Partner Content

Certain listing information may be supplied by playrooms, activity providers or commercial partners.

The relevant organizer is responsible for information it supplies to PlayroomNearby.

We may review, format, update, reject or remove organizer-supplied information.

Commercial relationships may include:

• enhanced listings;
• increased visibility;
• promotional placement;
• partner packages;
• other promotional services.

The existence of a commercial relationship does not by itself give an organizer access to individual users' personal account information.

20. Analytics and Privacy

PlayroomNearby uses analytics on supported platforms to understand how the Service is used and improve its functionality.

Our use of analytics, cookies, location information and other personal data is described in the Privacy Policy.

Where applicable law requires separate consent for a particular form of processing, acceptance of these Terms does not replace that consent.

21. Intellectual Property

Except for user-generated content and third-party materials, the original elements of PlayroomNearby — including software, interface, branding, design, text, graphics and database organization — are owned by or licensed to PlayroomNearby and are protected by applicable intellectual-property law.

You may use the Service for personal, lawful purposes.

Except where expressly permitted by law or by PlayroomNearby, you must not:

• systematically copy or extract substantial parts of the Service;
• scrape the Service or database using automated tools;
• reproduce PlayroomNearby branding without authorization;
• circumvent security or technical restrictions;
• reverse engineer protected elements of the Service;
• use automated extraction to create a competing directory or database.

22. Prohibited Use

You must not:

• use the Service unlawfully;
• interfere with its operation or security;
• attempt unauthorized access to accounts, servers or systems;
• upload malicious software;
• abuse the review or reporting systems;
• manipulate ratings or reviews;
• submit fabricated reviews;
• harass users, organizers or PlayroomNearby representatives;
• collect other users' personal data without authorization;
• use automation in a way that materially disrupts the Service;
• use PlayroomNearby to facilitate fraud or other illegal activity.

23. Suspension and Termination

We may restrict, suspend or terminate an account where reasonably necessary because of:

• serious or repeated violations of these Terms;
• abusive or prohibited user-generated content;
• fraud;
• manipulation of ratings or reviews;
• security threats;
• unlawful activity;
• attempts to compromise the Service.

Where reasonable, we may provide notice or an opportunity to address the issue.

We may act without prior notice where immediate action is reasonably necessary to protect users, third parties or the Service.

24. Account Deletion

Registered users may request deletion of their PlayroomNearby account.

PlayroomNearby provides a way to initiate account deletion from within the application and through a publicly accessible web resource.

Account deletion results in deletion or irreversible anonymization of associated personal data as described in the Privacy Policy, except where limited retention is required or permitted by applicable law.

Temporary suspension or deactivation is not treated as account deletion.

25. Service Availability and Changes

We may:

• update the Service;
• change or add features;
• remove features;
• change technical providers;
• temporarily suspend functionality for maintenance, security or technical reasons.

We do not guarantee that every feature will always be available on every platform, device or territory.

If a change materially affects users' rights or personal-data processing, we will provide appropriate information or update the applicable legal documents.

26. Disclaimer

PlayroomNearby is primarily an information and discovery platform.

To the maximum extent permitted by applicable law, information supplied through the Service is provided on an “as available” basis.

We do not guarantee that every third-party listing will at all times be:

• complete;
• accurate;
• current;
• available.

Nothing in these Terms excludes any consumer right, warranty or obligation that cannot legally be excluded.

27. Limitation of Liability

To the extent permitted by applicable law, PlayroomNearby is not responsible for acts or omissions of independent venues, activity providers or other third parties.

This may include matters relating to:

• changes in opening hours;
• cancellations;
• availability;
• prices;
• service quality;
• direct bookings;
• third-party communications;
• services provided at a venue;
• injuries or incidents attributable to the acts or omissions of an independent venue or activity provider.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

28. Changes to These Terms

We may update these Terms to reflect:

• changes to PlayroomNearby;
• new functionality;
• legal or regulatory requirements;
• technical changes;
• changes in the structure under which the Service is operated.

The current version will be available through the PlayroomNearby website and/or application.

Where required by applicable law, we will provide appropriate notice of material changes.

29. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Serbia, subject to mandatory consumer protections and other rights that may apply under applicable law.

If you have a complaint or dispute concerning PlayroomNearby, you may first contact us at:

so that we have an opportunity to resolve the matter.

Where permitted by law, disputes may be submitted to the competent courts in Belgrade, Serbia.

Nothing in this section deprives a consumer of any mandatory right concerning applicable law or jurisdiction.
